Legal investigators primarily work in the field where the event, which is the subject of the litigation, has taken place. While in the field, they strive to collect as much relevant factual information as possible. Legal investigators primary function is to conduct interviews with prospective witnesses and prospective parties to the litigation. They also seek out and interview prospective experts in technical areas related to the litigation.

This relevant factual information, also known as evidence, can be testimonial, documentary or physical. While legal investigators are always focused on the collection and examination of factual aspects of the investigation, they must still remain aware of the legal aspects as well. Most importantly they must abide by what constitutes legally relevant material, that is admissible and permissible in a court of law.

Once facts are collected and examined, the private investigator then supplies the information to an attorney who can then apply the law accordingly. Legal investigators work with attorneys in an effort to achieve the desired result for a client, which may be a favorable judgment, an agreed upon settlement or an amicable disposition. Legal investigators may be called upon for any type of civil litigation, that demands the collecting and sorting of complex and technical matters, however most often, they are utilized in the investigation of personal injury cases where they seek to determine the liability.

In addition to their technical training, legal investigators are also trained in human relations. Legal investigators are concerned with uncovering the truth relating to the investigation, however, this may be difficult with all of the irrelevant and misleading information available. As truth is not always synonymous with relevant facts, legal investigators must learn to carefully sift  through the assorted perceptions and determine what is actually relevant and factual. Only relevant factual information can truly help an attorney proceed with the best interests of their client.

The legal investigation profession is a rapidly growing field. As the amount of litigation increases, so does the demand for technically trained astute investigators. Attorneys increasing rely on legal investigators, to uncover the facts of the investigation and help the client arrive at their desired outcome.
